Content Moderation Policy

1. Purpose and Scope

SwapAnything provides AI-powered image and video tools, including face-swapping, clothes-changing, and other generative or editing features. This Content Moderation Policy explains what content is prohibited, how we review content, and what actions we may take when this policy is violated.

This policy applies to all prompts, instructions, images, videos, files, and other materials that you upload, submit, request, generate, store, or share through the SwapAnything website, APIs, or other Services, as well as your attempts to use the Services. It supplements our Terms of Service, Privacy Policy, and Refund Policy. If there is a conflict, the Terms of Service control.

2. Your Responsibilities

You must be at least eighteen (18) years old to create an account or use the Services.

You may use the Services only with content that you have the legal right to use. When content depicts a real person, you are responsible for obtaining that person's valid consent for the intended use and for respecting their privacy, publicity, intellectual-property, and other legal rights.

You must not attempt to evade our safeguards, including by cropping, blurring, disguising, encoding, repeatedly resubmitting, or otherwise altering prohibited content to avoid detection. You also must not use another account or automated process to bypass a restriction or suspension.

3. Prohibited Content

The categories below are prohibited. The examples are illustrative and not exhaustive. We may also restrict content that violates applicable law, creates a material risk of harm, infringes another person's rights, or is inconsistent with the purpose of the Services.

3.1 Minors and Child Sexual Exploitation

SwapAnything has zero tolerance for child sexual exploitation or abuse. You must not upload, request, generate, store, or share:

• Child sexual abuse material (CSAM) or any content that sexualizes, exploits, grooms, or endangers a minor;
• Nude, sexual, suggestive, fetishized, or intimate depictions of anyone under 18, whether real, fictional, illustrated, AI-generated, or age-ambiguous;
• Content that age-regresses a person into a minor in a sexual or exploitative context;
• Content that promotes, facilitates, or attempts to normalize the sexual exploitation of minors.

Because age cannot always be determined reliably from an image or video, the Services may reject any content that appears to depict a minor or an age-ambiguous person, even when the content is not sexual.

We may preserve and report suspected CSAM or child exploitation to competent authorities as required or permitted by law. Accounts associated with such content may be permanently terminated immediately.

3.2 Non-Consensual Intimate Imagery

You must not create, upload, or share non-consensual intimate imagery (NCII), including:

• Nude, sexual, or intimate depictions of a real person without that person's knowledge and valid consent;
• “Revenge porn,” sexualized deepfakes, or face-swaps that place a real person into an intimate or sexually suggestive situation;
• Content created for blackmail, extortion, coercion, harassment, humiliation, or sexual exploitation;
• Secretly recorded or unlawfully obtained intimate material.

Consent to take or possess an image does not by itself constitute consent to edit, sexualize, publish, or distribute it.

3.3 Pornography, Nudity, and Sexual Content

You must not upload, request, generate, store, or share:

• Pornography, sexual acts, explicit sexual content, or erotic nudity;
• Full or partial nudity intended to be sexual, suggestive, or pornographic;
• Fetish, bondage, sexual-violence, or sexually exploitative content;
• Content that advertises or directs users to pornographic or adult sexual services.

We may reject content containing exposed intimate body parts, transparent clothing, highly sexualized posing, or other adult or suggestive material, including lawful content, because our Services are not designed to process it.

Clothes-changing and body-editing tools are intended only for clothed, non-explicit edits. You must not use them to digitally undress a person, create see-through clothing or nudity, expose intimate body parts, or produce pornographic, exploitative, or non-consensual imagery.

3.4 Public Figures, Impersonation, and Deceptive Synthetic Media

The Services may reject content depicting celebrities, politicians, or other public figures. You must not use SwapAnything to:

• Create deceptive or harmful synthetic media involving a real person without authorization;
• Impersonate another person for fraud, manipulation, defamation, harassment, or reputational harm;
• Falsely present generated or edited content as authentic evidence;
• Mislead people about elections, civic processes, public emergencies, armed conflicts, or matters of public importance.

3.5 Harassment, Exploitation, and Privacy Violations

You must not use the Services to:

• Threaten, stalk, bully, dox, defame, or harass another person;
• Blackmail, extort, exploit, or publicly humiliate another person;
• Disclose private or sensitive personal information without authorization;
• Facilitate human trafficking, sexual exploitation, or coercive control.

3.6 Violence and Graphic Content

You must not upload, request, generate, store, or share:

• Graphic violence, gore, torture, mutilation, extreme injury, or human remains;
• Content that praises, promotes, threatens, or instructs real-world violence, terrorism, or mass harm;
• Animal cruelty or abuse;
• Content that facilitates violent crime or the construction or use of weapons for unlawful harm.

3.7 Hate and Extremism

You must not create or share content that promotes, praises, or incites hatred, discrimination, dehumanization, or violence against a person or group based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, or another protected characteristic.

Content that supports terrorist or violent extremist organizations, propaganda, recruitment, praise, symbols used for promotion, or operational assistance is also prohibited.

3.8 Suicide and Self-Harm

You must not upload, request, generate, store, or share content that encourages, romanticizes, graphically depicts, or provides instructions for suicide, self-harm, or eating-disorder behavior.

3.9 Illegal, Fraudulent, or Dangerous Activity

You must not use the Services to promote, facilitate, or provide instructions for:

• Fraud, scams, identity theft, forgery, or financial crime;
• Illegal drug production or trafficking;
• Unauthorized access, malware, or other cyber abuse;
• Illegal weapons, explosives, or the commission or concealment of a crime;
• Any other activity that violates applicable law.

3.10 Intellectual-Property and Other Rights

You must not upload or use content that infringes copyrights, trademarks, rights of publicity, privacy rights, or other proprietary rights. You are responsible for securing all licenses, permissions, and releases required for your inputs and intended outputs.

4. How Moderation Works

We may use automated systems and, where appropriate, human review to evaluate content and activity before, during, or after processing. Moderation may apply to uploads, prompts, generated outputs, account activity, and reports submitted to us.

Our systems may identify risk categories such as adult or explicit content, suspected minors, or public figures. Depending on the context and available information, we may:

• Prevent an upload or generation request from being processed;
• Withhold, disable, or remove an output;
• Record a policy violation or attempted violation;
• Request additional information;
• Refer content for further review.

Automated systems can make mistakes. We may act conservatively when a person's age, identity, consent, or the legality of content is uncertain. The temporary unavailability of a moderation system may also prevent content from being processed.

We do not guarantee that all prohibited content will be detected. The absence of a warning or block does not mean that content is permitted or that your use of it is lawful.

5. Enforcement

We consider the nature and severity of the content, the risk of harm, applicable law, the user's history, and whether attempts were made to evade safeguards. Enforcement actions may include:

• Warning the user or recording a violation;
• Rejecting a request or removing access to content;
• Restricting features or account access;
• Temporarily suspending an account;
• Permanently terminating an account;
• Preserving relevant records and reporting content or conduct to competent authorities.

Severe violations may result in immediate permanent termination without a prior warning. Repeated attempts to submit prohibited content may also result in permanent termination.

If an account is suspended or terminated for a prohibited-content violation, amounts already paid, including unused credits or subscription time, are non-refundable as described in our Refund Policy.

6. Reporting Content and Appealing a Decision

If you believe content or activity involving SwapAnything violates this policy, or if you are depicted in non-consensual or otherwise harmful synthetic media, you may submit a report through our website or contact us at [email protected]. Include enough information for us to locate and assess the content, such as relevant URLs, account information, screenshots, or execution details. Do not email CSAM or other illegal content; instead, provide only the information needed to identify its location.

If you believe your content or account was restricted by mistake, you may appeal by emailing [email protected] from the address associated with your account. Explain the decision you are appealing and why you believe it was incorrect. We may request additional information to verify identity, rights, consent, or context. An appeal does not guarantee reversal, and we may decline repeated or abusive appeals.

7. Privacy and Record Retention

To operate the Services and enforce this policy, we may scan, review, and temporarily process content and related account or technical information. We may retain records of moderation decisions and violations as reasonably necessary to prevent abuse, resolve appeals, protect users, comply with legal obligations, and enforce our agreements.

8. Policy Updates

We may update this policy to reflect changes to our Services, moderation practices, legal obligations, or safety risks. The “Last Updated” date indicates when the latest version became effective. Your continued use of the Services after an update is subject to the revised policy.
